Specific conditions of the purchase process

The general terms and conditions of sale described below (hereinafter, the "General Terms and Conditions") exclusively govern the contractual relationship between any user of the website www.vinoteca.es (hereinafter, the "User" or "you") and the seller, Delicommerce S.L., with VAT number B86490026 (hereinafter, "Delicommerce").

These General Terms and Conditions are the only applicable terms and replace any other general conditions, unless previously, expressly and in writing cancelled. Delicommerce may occasionally modify these conditions, so it is advisable to read them on each visit to the website www.vinoteca.es (hereinafter, the "Website"). Any modifications shall apply from the moment they are published online and shall not have retroactive effect.

Each purchase is governed by the conditions in force on the date of the order. By placing an order, you accept our General Terms and Conditions without reservation, after having read them.

By accessing the Website, you undertake to comply with these General Terms and Conditions and the associated Terms of Use.

2. Prices: All prices are shown in euros and include VAT. We reserve the right to modify them, but the prices in force at the time of placing the order shall apply.

3. Availability: Orders are shipped subject to stock availability. If a product is not available, we will inform you within a maximum period of 15 days. We may offer you an equivalent product or issue a refund. Note: the bottle capacity indicated for wine coolers is based on standard Bordeaux bottles.

Certain products may be identified on the website as made-to-order, custom-made, personalised or subject to specific production by the manufacturer. In these cases, the delivery time and the cancellation or return conditions may be subject to the specific terms indicated on the product page and in these General Terms and Conditions.

4. Shipping methods and payment methods: We ship to mainland Spain and the Balearic Islands. Shipments are carried out through DHL, Envialia, Correos Express, Seur, etc., with an estimated delivery time of between 24 and 48 working hours. We are not responsible for delays caused by third parties or force majeure. If the package does not arrive, an investigation will be opened with the carrier, which may take up to 14 working days.

Please check the condition of the order upon delivery. If you detect any damage, record it on the delivery note. In the event of an incident, contact pedidos@vinoteca.es on the same day or, at the latest, within one working day after delivery. Returns will only be accepted if the product is in its original condition.

For security reasons, additional information may be requested when payment is made by card. For high-value orders, an ID document and proof of address may be required. Please provide a valid email address and contact telephone number.

Special delivery conditions: For deliveries to upper floors without a lift or with difficult access, the customer must provide the necessary means or request an additional delivery assistant in advance, with the cost to be determined according to the level of difficulty. Installation is not included.

Payment methods: Credit or debit card (Visa, Mastercard), bank transfer, PayPal and deferred payment with SeQura. The charge is made upon shipment, provided it has been authorised by the bank. Card payments are processed through Servired using encrypted transactions.

You authorise us to issue the invoice in electronic format. You may request a paper invoice by contacting customer service.

5. Returns policy:
You may return any product within 30 days from receipt. Claims for transport damage must be made within 24 hours of delivery.

Exclusion of the right of withdrawal and cancellation for made-to-order products: In accordance with Article 103, section c) of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal shall not apply to contracts relating to the supply of goods made to the consumer’s specifications or clearly personalised.

Therefore, for products identified on our website as made-to-order, custom-made, personalised or manufactured expressly after confirmation of the order, the customer accepts that, once the order has been confirmed and the manufacturing or production order has been initiated, the right of withdrawal, cancellation or return shall not apply, except in the legally established cases of lack of conformity or product defect.

The manufacturing or production process shall be deemed to have begun from the moment the supplier or manufacturer has generated, confirmed or sent the production order to the factory. From that moment onwards, no cancellations, modifications or returns of the order shall be accepted for reasons unrelated to defects or lack of conformity of the product.

This condition shall apply in particular to products from brands or models manufactured exclusively to order, such as certain EuroCave wine coolers or other products that may be added in the future under the same modality.

We will arrange collection of the product to be returned, with return shipping costs borne by the customer. The product must be returned in its original packaging or equivalent packaging. Incomplete or damaged products will not be accepted. The refund will be issued once everything has been verified as correct.

6. Guarantees and after-sales service: All products have a 36-month guarantee, in accordance with current legislation. In the event of a defect, the product will be repaired, replaced or refunded free of charge. Any lack of conformity must be reported within a maximum period of 3 years from delivery.

The guarantee does not cover: consumables, improper use, damage caused by third parties, faults resulting from handling by unauthorised services, or damage caused by external factors such as lightning, accidents, etc.

7. Disputes and liability: These Conditions are governed by Spanish law. In the event of a dispute, the User may refer the matter to the courts of their place of residence or to Confianza Online (www.confianzaonline.es).

8. Personal data protection: Your data is necessary to process orders and invoices. Delicommerce is responsible for the file, which is registered with the Spanish Data Protection Agency. You may exercise your rights by contacting info@vinoteca.es or by postal mail. Your data will not be transferred to third parties. You may unsubscribe from our promotional communications at any time.

9. Intellectual property: All content on www.vinoteca.es, including texts, images, videos and trademarks, is the property of Delicommerce S.L. or its suppliers. Any reproduction without express authorisation is prohibited.
